This version reflects Plantalume’s current technical and commercial setup. A renewed legal review is required before enabling real payments, new service providers or additional markets.
1. Scope and contracting party
These terms apply to orders placed through plantalume.com and Growpad subscriptions expressly offered there for payment. The contracting party is Cinecart GmbH, Am Schlahn 1, 14476 Potsdam, Germany, represented by Sebastian Merk, email: mail@plantalume.com (“Plantalume”). A consumer is a natural person acting mainly outside their trade or profession; an entrepreneur acts in the course of a commercial or independent professional activity.
2. Order and conclusion of contract
Product pages are invitations to place an order, not binding offers. Customers add products to the cart, review and correct their details and submit a binding offer through a button clearly indicating an obligation to pay. A contract is formed only when Plantalume expressly accepts the offer in text form or dispatches the goods. A purely technical receipt notice is not acceptance. If checkout is marked as test mode or no approved payment method is available, no purchase contract requiring payment is formed.
3. Contract languages and contract record
Contracts may be concluded in German, English, French, Spanish or Italian; the version selected during checkout applies. Order information is shown in the customer account where one exists. Customers may save or print these terms before ordering. Legally required contract information is provided on a durable medium after conclusion.
4. Products and technical information
The agreed product description and characteristics confirmed during checkout govern. Images are illustrative mockups; minor reasonable variations in colour, surface or packaging may occur without affecting function or agreed quality. Grow One must be used in accordance with its instructions, safety notices and stated electrical ratings. Growpads contain natural materials; germination time, growth and yield also depend on storage, water, temperature, light and care. Statutory remedies remain unaffected.
5. Prices, shipping and payment
Prices shown to consumers are total prices including applicable VAT. Any shipping charges are shown before the order is submitted. Only payment methods displayed during checkout are available. Payment is collected only after a valid contract has been formed and in accordance with the selected method. Plantalume is not required to offer any particular payment service permanently.
6. Delivery
Delivery territory, estimated delivery time and shipping costs are shown in the shop or checkout. Reasonable partial deliveries are permitted if they do not create extra shipping charges. If goods cannot be obtained despite a matching procurement transaction and without Plantalume’s fault, customers will be informed promptly and payments refunded; statutory rights remain unaffected. For consumers, risk generally passes only when the goods are handed over.
7. Retention of title
Goods remain the property of Cinecart GmbH until paid for in full. For entrepreneurs, retention of title continues until all claims from the ongoing business relationship have been settled.
8. Growpad subscriptions
A paid subscription is formed only if the price per shipment, interval, term, cancellation rules and payment method are clearly shown before completion and Plantalume accepts the order. A planning or test entry in an account without price and payment confirmation is not a paid subscription. Unless agreed otherwise, a confirmed subscription continues indefinitely and may be cancelled at any time through the account or by emailing mail@plantalume.com for shipments not yet initiated. Pauses, variety changes and interval changes apply only to future shipments not yet prepared. Price changes apply only after timely notice and to future shipments; mandatory cancellation rights remain unaffected.
9. Consumer right of withdrawal
Consumers generally have a statutory fourteen-day withdrawal right for distance contracts. For goods, the period normally starts when the consumer or a nominated third party receives them. A clear statement sent to Cinecart GmbH, Am Schlahn 1, 14476 Potsdam, Germany, or mail@plantalume.com is sufficient; timely dispatch meets the deadline. Statutory exceptions apply, notably to clearly personalised goods or opened sealed goods unsuitable for return for health or hygiene reasons. Growpads are not excluded merely because they contain seeds.
10. Effects of withdrawal and model form
Following a valid withdrawal, Plantalume refunds payments, including the least expensive standard delivery charge offered, within fourteen days. Reimbursement may be withheld until the goods are returned or proof of return is supplied. The same payment method is generally used. Goods must be returned within fourteen days and consumers bear direct return costs. Compensation for diminished value is due only for handling beyond what is necessary to inspect nature, characteristics and functioning.

11. Statutory conformity rights and guarantees
Statutory remedies for defects apply and are not restricted for consumers. Any additional guarantee exists only if expressly stated for the product and does not affect statutory rights. For entrepreneurs, the warranty period for newly manufactured goods is one year where legally permissible, excluding in particular claims under section 12 and mandatory statutory cases.
12. Liability
Plantalume has unlimited liability for intent and gross negligence, injury to life, body or health, product liability, guarantees and other mandatory cases. For a slightly negligent breach of an essential contractual duty, liability is limited to foreseeable loss typical for the contract. Liability for other slight negligence is excluded. These limits also benefit legal representatives and agents.
13. Consumer dispute resolution
Cinecart GmbH is neither obliged nor currently willing to participate in proceedings before a consumer arbitration body. The former EU Online Dispute Resolution platform has been discontinued, so no outdated platform link is provided.
14. Governing law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not deprive them of mandatory protection in their country of habitual residence. Potsdam is the exclusive venue for merchants, public-law entities and public-law special funds; otherwise statutory venues apply.
